Commission refers Poland to the Court of Justice of the EU

The European Commission has decided to refer Poland to the Court of Justice of the European Union for not having established a national electronic register of road transport undertakings and for not having connected it with the national electronic registers of the other EU Member States as required

National registers should have been established and connected with each other on 31 December 2012 at the latest. Since Poland has not yet complied with these obligations, which results in an inefficient functioning of the interconnection of the registers at the Union level, the Commission has decided to refer Poland to the Court of Justice of the EU. 


Transparency is a cornerstone for achieving an internal market in road transport. The rules obliges Member States to create a national electronic register of road transport undertakings which have been authorised by the competent authorities to engage in the occupation of road transport operator. The national registers must be interconnected with each other.


The interconnection of national registers is necessary to facilitate the flow of information between Member States on possible infringements committed by companies carrying out haulage or passenger transport at international level (such as exceeding allowed driving times or tachograph fraud). This contributes to making the Union's roads safer.
